Disclaimer:

1. I understand that this activity is a physically demanding activity, have carefully read the relevant instructions and rules of this activity, and am aware of the related medical and natural risks involved. I understand that the activity includes (but is not limited to) water sports, covering daytime and nighttime activities. I declare that I am in good physical condition and capable of participating in this activity. I possess basic swimming ability (meaning I can swim 30 meters on my own without assistance from others, and no practicing doctor has advised against it). I voluntarily participate in this activity and am willing to bear all accidental risks and responsibilities myself. For any accidents, death, or losses of any form caused to myself during the journey to and from the activity site and during the activity, I have no right to claim compensation or pursue liability from HOLIMOOD / Sai Kung Ha Ha Yun Hai (Fat Kee) Store / any related staff.

2. I agree:
All photos or portraits of myself participating in the activity may appear in any official footage, advertisements, TV reports, and all multimedia platforms, and I agree to their publication in different forms without any remuneration. The venue has absolute usage rights over all videos, images, and records of this event.

I authorize and agree that the organizer and media may use my personal data, portrait, name, and voice for organizing and promoting the event without review or additional consent from me, including possible use of my portrait and name on the organizer's event website, videos, and promotional materials.

3. I confirm and agree:
HOLIMOOD shall not be liable in the following circumstances (but not limited to):
– Any personal loss or injury;
– Any direct or indirect losses caused (whether personal injury or property damage)

Our company is a rental platform providing services for selling experience tickets. Participants are responsible for their own actions, and HOLIMOOD will not bear any legal responsibility for their personal actions, including but not limited to gathering restriction measures.
Under any circumstances, from the date of my registration submission, the organizer, sponsors, supporting units including staff shall not be required to compensate or bear any legal responsibility for any losses or accidents occurring under any circumstances.

The agreements and provisions stipulated in this statement are agreed upon by both parties. If any agreement in this statement is deemed invalid or unenforceable by any court or administrative body, such invalid or unenforceable agreement shall not affect the other provisions of this statement, and the provisions of this statement shall retain legal binding force.

Notes:
1. Participants must be 18 years or older; those under 18 must be accompanied by parents/guardians, rent double kayaks, and bear all responsibilities.
2. Participants must take care of their own and companions' safety, always looking after children and those needing care from the group.
3. Participants must follow staff instructions to conduct the activity.
4. Participants please follow staff instructions and properly wear safety equipment.
5. Due to hygiene issues, participants are advised to bring their own gloves.
6. Do not litter, protect our nature.
7. Participants must keep their own belongings; if lost, the applicant group is responsible.

How to Use

• Must show Holimood confirmation email when participating in the activity
• Activity open time: 0900am-0500pm
• Activity only applicable to confirmed booking date and time, expires if overdue
• Orders after confirmation no refunds or changes
• If Observatory issues No.1 signal or yellow rainstorm warning or above 2 hours before departure, itinerary can be rescheduled or refunded, please contact [email protected] by email
• If need to change booking due to the above bad weather, must notify in writing before departure and provide desired new date; customer must use within one month of original date, otherwise forfeited if not booked.
• If voucher effective date is delayed and price changes due to time slot (e.g., from busy to normal slot), difference will not be refunded.
• If changed slot is from normal to busy, additional amount must still be paid.
• Overdue notification for change considered as proceeding as scheduled
• Service provider will decide based on departure day conditions if activity poses danger or is suitable for water activities. If conditions not suitable, activity postponed, booking can be rescheduled for free; rescheduling terms follow bad weather arrangements. If no notification received, activity proceeds as scheduled.
