Terms and Conditions
Disclaimer:

1. I understand that this activity is a physically demanding activity. I have read the relevant instructions and rules of this activity in detail, and I am aware of the relevant medical and natural risks involved. I understand that the activity includes (but is not limited to) water sports, and covers both daytime and nighttime activities. I declare that I am in good physical condition and capable of participating in this activity. I possess basic swimming ability (meaning I can swim 30 metres on my own without assistance, and no practising doctor has advised against it). I am participating in this activity voluntarily and am willing to bear all accident risks and responsibilities myself. I have no right to claim compensation or pursue liability against HOLIMOOD / Sai Kung Hoi Ha Wan Hoi Store / any related staff for any accidents, death, or any form of loss caused to myself on the way to and from the activity venue or during the activity.

2. I agree:
That all photos or portraits of me participating in the activity may appear in any official recordings, advertisements, television reports, and all multimedia platforms, and I agree to their publication in various forms without receiving any remuneration. The venue has absolute rights to use any videos, images, and recordings of this activity.

I am willing to authorise and agree that the organiser and the media may use my personal data, portrait, name, and voice for the organisation and promotion of the activity without review and without my further consent, including the possibility that my portrait and name may be used on the organiser's related activity webpages, short videos, and promotional publications.

3. I confirm and agree:
That HOLIMOOD shall not be held liable under the following circumstances (but not limited to):
– Any personal loss or injury;
– Any direct or indirect loss (whether personal injury, death, or property loss)

Our company is a rental platform providing the service of selling experience packages. Participants must be responsible for their own personal behaviour. HOLIMOOD will not bear any legal liability for their personal behaviour, including but not limited to gathering restriction measures.
Under no circumstances, from the date I submit my registration, shall the organiser and all sponsoring and supporting units, including staff, be required to provide compensation or bear any legal liability for any losses and accidents occurring under any circumstances.

The agreements and provisions set out in this statement are mutually agreed by both parties. If any provision of this statement is deemed invalid or unenforceable by any court or administrative body, such invalid or unenforceable provision shall not affect the other provisions of this statement, and the provisions of this statement shall remain legally binding.

I have read in detail and agree to the above exemption and disclaimer clauses, and the disclaimer, rules, and all terms and conditions.


Precautions:
1. Participants must be aged 18 or above. Those under 18 must be accompanied by a parent and must rent a double kayak, and the parent shall bear all responsibilities.
2. Participants must take care of their own safety and that of their companions, and must at all times look after children and persons in need of care who are accompanying them.
3. Participants must follow staff instructions when carrying out the activity.
4. Participants should follow staff instructions and properly wear safety equipment.
5. Due to hygiene concerns, participants are advised to bring their own gloves.
6. Please do not litter. Protect our nature.
7. Participants must keep their personal belongings safe. The applying group shall be responsible for any loss.

How to Use

• You must present the Holimood confirmation email when participating in the activity
• Activity opening hours: 0900am-0500pm
• The activity is only valid on the confirmed booking date and time. It will be void after expiry.
• No refunds or changes are allowed after order confirmation
• If the Observatory hoists Signal No. 1 or issues an Amber Rainstorm Warning or above 2 hours before departure, the trip may be rescheduled or refunded. Please contact the merchant first to apply.
• If the booking must be changed due to the above severe weather issues, written notice must be given before departure together with the desired rescheduled date. Customers must use it within one month of the original date. Those who fail to make a booking by then will be deemed to have forfeited it.
• If the price changes due to the time slot after the voucher effective date is postponed, such as from a peak time slot to a regular time slot, the difference will not be refunded.
• If the customer changes from a regular time slot to a peak time slot, the additional amount incurred must still be paid
• Those who notify of a change after the deadline will be treated as departing as scheduled
• The service provider will decide based on the conditions on the day of departure whether the activity is dangerous and whether it is suitable for water sports. If the conditions on the day are not suitable for water sports, the activity will be postponed and the booking may be rescheduled free of charge. The rescheduling terms may follow the severe weather arrangements. If customers do not receive any notice, the activity will proceed as scheduled.
